By accessing or using KinHug ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.
2. Accounts and Eligibility
To use KinHug, you must:
- Be at least 13 years old (or have parental consent if under 13)
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
You are responsible for all activities that occur under your account.
3. User Content and Ownership
Your Ownership: You retain all ownership rights to the content you create and share on KinHug (photos, voice recordings, text, etc.).
License to Us: By uploading content, you grant KinHug a limited, non-exclusive license to store, display, and transmit your content solely for the purpose of providing the Service to you and your family members.
Family Sharing: Content you share within a family space is visible to all members of that family. You are responsible for ensuring you have the right to share any content you upload.
4. Prohibited Content and Behavior
You agree not to:
- Upload content that is illegal, harmful, threatening, abusive, or violates others' rights
- Impersonate others or provide false information
- Attempt to gain unauthorized access to the Service or other users' accounts
- Use the Service to spam, harass, or harm others
- Reverse engineer, decompile, or attempt to extract the source code of the Service
- Use automated systems to access the Service without permission
We reserve the right to remove content and suspend accounts that violate these Terms.
5. Privacy and Cookies
Your use of KinHug is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal data. By using the Service, you consent to our privacy practices.
6. Subscription and Billing
Currently, KinHug may offer free and paid features. If and when paid subscription plans are introduced:
- Subscription fees will be clearly disclosed before purchase
- Payments are processed securely through Stripe
- Subscriptions renew automatically unless cancelled
- Refunds are subject to our refund policy (to be specified when paid plans launch)
You are responsible for any taxes applicable to your purchases.
7. Service Availability and Changes
We strive to keep KinHug available 24/7, but we do not guarantee uninterrupted access. The Service may be unavailable due to:
- Maintenance and updates
- Technical issues beyond our control
- Force majeure events
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
8. Disclaimer and Limitation of Liability
Service Provided "As Is": KinHug is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the Service's reliability, accuracy, or fitness for a particular purpose.
Limitation of Liability: To the maximum extent permitted by law, KinHug and its operators shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to loss of data, profits, or business opportunities.
Data Loss: While we implement backup and security measures, you are responsible for maintaining your own backups of important content. We are not liable for data loss.
9. Termination
By You: You may delete your account at any time through account settings. Upon deletion, your data will be removed within 30 days (subject to backup retention periods).
By Us: We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason we deem necessary to protect the Service and other users.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Sweden.
Note: This jurisdiction may be updated based on the actual location of KinHug's operations. Please check this section periodically.
11. Changes to These Terms
We may update these Terms from time to time. We will notify you of significant changes by email or through a notice on our website. Continued use of the Service after changes constitutes acceptance of the updated Terms.
